Where transport
is not provided by the Client, the Client
will be responsible for all travelling,
overnight and subsistence expenses
reasonably incurred by the interpreter(s)
and any necessary support staff.
Where travelling, overnight accommodation
and subsistence expenses are to be outlayed
by an interpreter Clicl2Interpret reserves
the right to require advance payment of such
expenses from the Client as a condition of
providing the Services.
Unless
otherwise agreed, payment is due within 15
days at the time of issue of the invoice to
the Client and is to be made to
Clicl2Interpret.
The Client
shall be liable for and shall indemnify
Clicl2Interpret against all costs and
expenses incurred by Clicl2Interpret in
respect of any steps, actions or proceedings
made or brought against the Client by
Clicl2Interpret to obtain payment of
outstanding fees and interest.
Clicl2Interpret
is not obliged to provide a native speaker
unless this is specifically agreed at least
one month in advance of the event.
The Client
shall be responsible for the provision of
all necessary hardware (such as booths,
headphones, microphones and etc.) together
with technical support staff required for
provision of the Services.
The Client will
state the general subject matter to be
interpreted on booking the Services. All
available supporting documentation will be
supplied by the Client to the interpreter as
far in advance as possible and in any event
not less than 9 days in advance of the
interpreting session. If the Client fails or
delays to produce such documentation,
Clicl2Interpret may either produce such
Services as may be reasonably secured in the
circumstances or decline to proceed, in
which case a cancellation fee will be
charged.
The Client
shall at its own expense retain duplicate
copies of all material provided to
Clicl2Interpret and insure against its
accidental loss or damage. Clicl2Interpret
shall have no liability for any such loss or
damage however caused.
The interpreter
has the right to withdraw his services if an
assignment is substantially different from
that described at the time of booking and if
to continue to work would be detrimental to
his or her own well being and professional
standing or if he or she feels that to
continue working would not be in the best
interests of the Client.
Should the
Contract be cancelled Click2Interpret
reserves the right to charge the Client the
amount of any loss or expense incurred or
cost of material used and a reasonable
amount of overhead charges and profits:
* Cancellation within 6 weeks before the
date set for commencement of the Services -
25% of the Fee;
* Cancellation within 4 weeks before the
date set for commencement of the Services -
75% of the Fee;
* Cancellation within 2 weeks before the
date set for commencement of the Services -
100% of the Fee.
The parties
acknowledge and agree that the above clauses
are a reasonable estimation of the loss
which would be incurred by the loss of the
person so employed or engaged.
Overnight
accommodation for the interpreter shall be
provided where:
- The interpreter would be unable to return
to his/her home by 20:00 pm after completion
of that day's Services; and
- The Services are required on the following
day.
- The cost of such overnight accommodation,
together with subsistence and travelling
expenses, shall be met by the Client.
Click2Interpret
secures every right and with the reservation
of any of its rights, which is not given
hereby precisely.
In the case
where, for the resolution of a dispute which
may result during the use of Click2Interpret
and the chosen procedure is the legal one,
competent and exclusive will be the Courts
of Athens and the applicable law will be the
Greek law. |
